We understand things change and We like to help fit in with Your plans. If You need to make any changes, reschedule or cancel Your Booking You must contact Us by email or SMS:

  • at least 24 hours prior to the Lesson if You are an individual; or
  • at least 72 hours prior to the Lesson if You are a Group.

Where you have contacted us as set out above we shall accommodate your change or reschedule or cancellation. If You have not given us the required notice we reserve the right not to accommodate the change or reschedule. In the case of a cancelation made in accordance with the notice requirements We will refund you promptly any Deposit or Balance Payment we hold. If You cancel and You have not given us the required notice (or simply do not turn up to Your Lesson for any reason whatsoever) then We will not refund any Deposit or Balance Payment. Where Your Booking is a Group Booking and a member of the Group cancels and You have not given us the required notice (or the member of the Group simply does not turn up to the Lesson for any reason whatsoever) then We will not refund any Deposit or Balance Payment for that member of the Group. EXTRA NOTICE REQUIRED TO STOP A DIRECT DEBIT PAYMENT PROCEEDING AFTER CANCELATION Where You are paying for Your Booking by Direct Debit We need extra time and notice – at least 2Weeks – to stop the Direct Debit deductions through Our third party provider Ezi Debit. The notice time required to stop the Direct Debit is governed by Ezi Debit’s terms and conditions and is not in Our control. Where You have made a change, rescheduled or canceled Your Booking via the requested email or SMS and You did so:

  • At least 24 hours prior to the Lesson if You are an individual; or
  • At least 72 hours prior to the Lesson if You are a Group.

…BUT not within enough time to stop a Direct Debit proceeding (as per the terms and conditions of Ezi Debit) then You can still request a Refund from Us after that Direct Debit was processed and We will reimburse You promptly.

SOMETIMES WE WILL NEED TO RESCHEDULE OR RELOCATE YOUR BOOKING

For Your safety and enjoyment We may need to reschedule Your Booking due to weather conditions which We, in Our sole discretion, decide are inappropriate for Your Lesson. PLEASE NOTE : As most rain is safe and fun We will not Usually
reschedule or relocate Your Booking due to rainy conditions!

Where We have made a decision to reschedule or relocate your Booking We will contact You as soon as possible to advise You and you will be given the option to either:

  • confirm the rescheduled or relocated Lesson with Us; or
  • Have Your Deposit or Balance Payment promptly refunded.

We also reserve the right to, at any time whether before or during a Lesson, remove You from a Lesson or cancel a Lesson where We, in Our sole and reasonably exercised discretion, decide that Your behaviour is disruptive or Your level of ability or physical health is unsafe. In this instance no refund will be made to You.

Acceptance of Risk Personal Injury While it is an exciting pastime, surfing does involve some dangers that are unpredictable and beyond Our control. There is always the chance that participants can be hurt or injured in this activity and so every participant is required to complete Our Declaration Form before entering any XL Surfing Academy program. Parents /Guardians must complete the form if the participant is under the age of 18. Our beaches, and all beaches for that matter, are at times subject to currents, troughs, rips, shallow sandbanks and strong winds. We strongly advise You to take the time to consider these factors before You sign the Declaration Form and participate in a Lesson.

Acceptance of Risk Property Damage/Theft for the same reasons detailed under Acceptance of Risk Personal Injury there is a chance that Your property may be damaged through Your participation in the Lesson. We shall not be held liable for any property damage or theft which occurs as a consequence of Your participation in the Lesson.

Damage to Our Property where You have not followed Our instructions or where You exercised reasonable care when using Our property or equipment and damage occurs, You authorise Us to make a Direct Debit Deduction for the reasonable cost of replacement for that item of property or equipment. Where a Direct Debit payment is not possible You agree to pay Our reasonable replacement costs on request.
